Terms and Conditions

1. BIKE RENTAL POLICIES

The customer hereby rents bicycles from MTBrental-Harz subject to all terms and conditions of this agreement:

1.1. MTBrental-Harz rents bikes only with prior booking. Overnight rentals can be agreed with MTBrental-Harz. At the end of the rental period, the customer must return the bicycles to MTBrental-Harz. The daily rental period is from 9 am to 21 pm.

1.2. If the customer fails to return the rented items to MTBrental-Harz within the agreed rental period, even for reasons beyond his/her control, MTBrental-Harz shall be entitled to demand compensation.

1.3. The rented items will be delivered/picked up on time and date according to the previous booking. The customer has to give clear information about the meeting point and place to deliver/pick up the rented items and provide a functional mobile number.

1.4. Any changes to the rental contract must be notified by the customer and confirmed by MTBrental-Harz. Any delays on delivery/pick up of the rented items will result in an additional charge to the customer.

1.5. Exceptional circumstances or force majeure could lead to a delay of delivery/pick up of the rented items. In such cases MTBrental-Harz will always notify the customer about the changes.

1.6. All rented items are presented in a perfect working order set up by professional mechanics. MTBrental-Harz accepts general wear and tear during the rental period, however any bicycle/equipment returned with excessive cleaning requirement will result in a 10€ charge of the customer.

1.7. The rented items should only be used by the designated customer and the members of his/her party as mentioned in the rental contract. The customer accepts to use the rented bicycle/equipment with all due care and correctness to observe road safety regulations. Customers are forbidden to use rented bicycle under the influence of alcohol or drugs. Customers are not allowed to modify or alter the rented item in any way.

1.8. The customer is obliged to take good care of the rented equipment and to protect it from damage, loss or theft. In case of damage, loss or theft of the bicycles, components or any of its parts, MTBrental-Harz will charge the customer the full cost of the missing or broken items at market prices. 

2. RESERVATION, PAYMENT, DEPOSIT, DELIVERY

2.1. Reservation 

Bike reservations must be done online prior to the rental period in order for MTBrental-Harz to confirm availability. If the customer urgently needs a bike on the same day, a reservation can be made through the phone.

2.2. Payment 

The customer must pay the full amount for the rented items prior to the rental period. The reservation is confirmed when MTBrental-Harz confirms receipt of the payment via e-mail. Payment is done online using credit card. Urgent rentals can be paid with credit card or cash when the bike is delivered.

2.3. Deposit 

On delivery of the rented items, the customer must read, accept and sign the rental agreement. The customer will be asked for passport details along with credit card details as a guarantee deposit for the rented equipment. Security deposit is 200€ for each bicycle. The customer signing the rental contract must be over 18 years old. At the end of the rental period, the customer accepts the charges for any missing or broken items at market prices which will be charged to their credit card. The deposit will be refunded if the rented equipment is returned in the same conditions it was procured. If the missing or broken items exceed the deposit amount, the customer must settle the balance.

2.4. Delivery 

The delivery and pick up of the bike costs 60 euros and must be paid at the time of booking.

3. RESPONSIBILITY OF CUSTOMER 

3.1. The customer accepts the charges for any missing or broken items at market prices at the end of the rental period agreed in the contract. If the missing or broken rented items exceed the deposit amount, the customer must settle the balance.

3.2. Cancellations without charge are only admitted 20 days before the rental date. Cancellations made later than 20 working days before the rental period will be charged the full amount of the prepaid bicycles/equipment. No shows would be charged in full, and considered non‐refundable. Exceptions to this policy cannot be made for any reason.

3.3. MTBrental-Harz does not provide a refund for early return of rented items. MTBrental-Harz cannot be held responsible for the customers personal circumstances, sicknesses, weather conditions or any other event of force majeure. The customer accepts that no refunds would be made for any of the above reasons without any exceptions.

3.4. The customer is obliged to make provision for the protection of the rented items, as well as the protection from loss and theft. In case of theft or loss during the rental period, the customer has to bear all the costs for the reconditioning at market prices. From the moment of signing the contract and receiving a rented item, the customer is fully responsible for the rented items.

3.5. In case of theft or loss of the rented bicycles/equipment, MTBrental-Harz applies a charge of minimum: 1000€ per aluminium road bike and 4000€ per carbon road bike, e-bike and mountain bike.

3.6. If the rented item is found after it was stolen, MTBrental-Harz will contact the customer.

3.7. MTBrental-Harz recommends customers to sign a Travel Insurance that covers rented items against loss, theft & damages. In case of theft or damage, MTBrental-Harz will do the best and cooperate with clients insurance. 

4. ISSUES WITH RENTED ITEMS DURING THE RENTAL PERIOD

4.1. Small reparations on rented items such as punctures are the customer’s responsibility. Regarding all other repairs on rented items during the rental period, the customer must contact MTBrental-Harz as soon as possible and agree on the service charges.

4.2. If the issue is caused by a faulty part on the bicycle/equipment, MTBrental-Harz takes full responsibility and will repair/replace the bicycle without extra cost.

4.3. If the issue with the bike is caused by the customer due to a crash or lack of mechanics knowledge, the customer takes full responsibility and must pay for the repair/support needed.

4.4. When the customer has agreed to the service charges MTBrental-Harz will meet the customer at the agreed meeting point and repair/replace the bicycle/equipment. MTBrental-Harz does not accept repair costs made by other mechanics unless this has been agreed on prior to the repairs. 

5. LIMITATION OF LIABILITY

5.1. MTBrental-Harz has a third party liability insurance coverage of the bicycle rental activity. MTBrental-Harz is not responsible for injury or damages caused to/by the client during the rental period.

5.2. The customer is responsible for sufficient personal insurance coverage for risks that may occur during the rental period. MTBrental-Harz is not liable for any claims for bodily injury or harm, accidents or loss of personal belonging caused by weather, sickness, persons, cars or any other causes and causers.

5.3. The customer must respect Spanish traffic regulations. Any ticket or fine due to incorrect use of the bicycle will be completely imposed upon the customer.

5.5 The provisions in this contract are subject to German law. For all disputes arising from this contract or relating to this contract, the case law is located in Harz, Germany.
